Statistics on Recidivism from the DOJ

The least shocking news I've read this week, released prisoners are rearrested at high rates. Recidivism of Prisoners Released in 34 States in 2012: A 5-Year Follow-Up Period (2012–2017)

I can't decide if I'm surprised or not by these statistics.

Among state prisoners released in 2012 across 34 states, 62% were arrested within 3 years, and 71% were arrested within 5 years (figure 1).

Then there are the parole violations that resulted in "return to prison."

As I said, I can't decide if 71% recidivism is a surprise, or that it took 5 years for them to be rearrested is a surprise.

There are some issues with the data, which I suppose is why only 34 states are used in the study. The data from the other states was either not available or just horrible in terms of accuracy.

Another Failure of the Victim-selection Process

He probably thought it was safe to threanten an old man. He was wrong. SPD: Homeowner fatally shoots trespasser in self-defense; victim identified

The trespasser, Darnell D. Smith, 33, allegedly made a threatening move towards the resident. Fearing for his life, he fired two shots, striking Smith at least once, police say.

The would-be bad-guy died at the scene.

No charges were filed against the homeowner.

Self-defense is a human-right.

You've Got A Friend

There has been some discussion - by me and in the comments - about how a lot (most?) of the Rock & Roll music from the 1970s is drek. Here is a song that isn't drek from 1971, but it also isn't Rock.

Discogs calls this "Pop Rock," but a number of music critics, who I agree with, call it Folk Music. Mostly accoustic guitar and voice, with some very low-key percussion. Doesn't sound like Rock to me.

This song is "You've Got A Friend" by James Taylor from his 1971 album Mud Slide Slim and the Blue Horizon. It was written by Carole King and included on her 1971 album Tapestry first.

Texans Are Still Armed

Home invaders are still getting shot. Teenager shot following gunfight with resident during home invasion.

Police said a 17-year-old boy broke into the home armed with a rifle and a handgun. The home had four people inside. At some point, one of the people inside the home opened fire on the suspect who was trying to rob the house.

A gunfight ensued between the suspect and resident, which ended with the suspect being shot.

Police caught up with the guy who got shot at a local hospital.

The homeowner is not facing charges at this time, but the investigation continues.

Self-defense Is Legal in Missouri

It took the DA two and a half months to come to that conclusion, which is really pretty quickly for the legal system. St. Joseph woman won't be prosecuted in husband's death

Prosecutor Ron Holliday said investigators determined the shooting occurred because of domestic violence and Dawn Applegarth was in fear for her life or serious injury at the time.

Mark Applegarth was prosecuted for domestic abuse against his wife in January, according to online court records

He was a risk, and she took steps to be able to defend herself.

Good Guys 1, Bad Guys 0.

Things are going to get much worse before they get better in our big cities. Chicago police officers caught in roiling mess of fear, shock, anger — and hesitation

Cops “are disgusted with the spectrum of every profound decision made under stress being parsed and analyzed to death,” a police source said. “And, yes, there is talk of standing back instead of risking their family’s future on an honest mistake of a moment.”

I think the big cities, because Chicago is not alone in this, are going to discover what happens when you don't insist on ANY enforcement of the rule of law. Worse than they have now. Or in other words, "How low can you go?"

“They’ve been working 12-hour days with no days off for weeks, maybe a month due to soaring crime; eight fatalities every weekend, 50 shot, a city out of control and in a downward spiral,” the source said.

“The cops are being held accountable, probably to 15 agencies, but nobody seems to be calling the politicians to be held accountable ... or anyone in this s- - -storm,” the source added.

Shooting and murder are increasing at alarming rates, carjacking is out of control. And what is the City Council spending time on? Renaming Lake Shore Drive, because that is the most critical issue facing the city at this time.

It really was a magnificent city, once upon a time.

Chicago Mayor's Failed Anti-violence Campaign

Lori Lightfoot has failed the city of Chicago. Nearly a year into Lightfoot’s anti-violence plan, many of Chicago’s most dangerous neighborhoods are doing worse.

The plan was to provide housing resources, anti-violence initiatives, and jobs. So how is that working out? Not very well.

Fatal shootings in West Pullman are up 566% from this time two years ago, North Lawndale 201%, South Lawndale 160%, Chatham 116%. Only three of the areas targeted by City Hall are down from 2019: West Englewood, Roseland and Humboldt Park.

Yet the administration has yet to funnel any extra assistance to some of those dangerous neighborhoods, particularly on the Far South Side, according to the city’s website. The West Pullman community area, for example, has received none of the $36 million released by City Hall under the plan this year.

The only thing that City Hall has "accomplished" is making sure that cops are unable to enforce the law. No car chases. They are dangerous. No foot chases either. They are also dangerous.

She did keep a platoon of cops surrounding her house during the worst of the rioting. Because she's special.

Lucky the Owner Was Armed

He tried to rob Lucky Donuts. Man tries to rob donut shop in Redding, gets shot, flees and sets stolen truck on fire | KRCR

[Robert Keo, owner of Lucky Donuts,] told police the suspect's truck slammed into his back door and tore it off of its hinges. The man then entered through the opening created by the crash. In the police report, Keo said he feared for his life and warned the suspect to leave his shop.

The suspect did not listen and continued to move into the shop. Keo then fired one shot in self-defense which hit the suspect.

The truck was stolen, and it was later set on fire.

The suspect is still on the loose.

So I wonder if Lucky Donuts is a cop hangout. (Yeah, I went there.)

NYPD Officer Saves Life with Ingenuity

This is a great story. It is from a week or two ago, but I missed it then. New York police officer saves man's life by patching up chest wound with potato chips bag and tape | Fox News

An officer arrived on the scene of a stabbing where a man had been stabbed in his lung.

He didn't have a proper chest-seal, so he improvised.

Upon arriving, a man who was hunched over on the sidewalk told him that the suspect caught "me in my lung." Officer Kennedy immediately directed one man to get a bag of chips and tape from a nearby bodega, and for two other men to help him lay the man on his back.

WARNING: THIS VIDEO CONTAINS GRAPHIC CONTENT

Officer Kennedy quickly emptied the bag and taped it over the man's wound to try to prevent his chest cavity from filling with air.

Paramedics replaced that with a proper chest-seal.

The attending physician at Harlem Hospital said Officer Kennedy's actions saved the victim's life, according to the NYPD.

I haven't checked, but I doubt this story recieved national media attention, because showing police doing good things doesn't fit with the national media's propaganda campaign.

Florida Man Gets Stuck in the Mud Running from Police

Robert Daniel Dean, 36, has been charged with two counts of grand theft auto, grand theft, dealing in stolen property, DWLSR habitual, flee and elude, two counts of violation of probation.

He got stuck in traffic related to a previous accident, or breakdown. He nearly hits the towtruck, and a pedestrian. The reactions of the drivers around the stop are interesting because people don't usually have the sense to get out of harms way.

Suspect: I'm sorry.
Deputy: I don't care, dude.

My hunch — and it is only a hunch — is that this “surge” hype is really being driven by the teachers unions, who want to keep schools closed, and are exerting pressure on the Democratic Party who, in turn, are pumping out “surge” propaganda via their media allies. Part of this message is about scapegoating Republicans as responsible for vaccine “resistance,” even though the lowest vaccination rates are among blacks and Hispanics, both of whom are key Democratic Party constituencies.

I think it is more likely something related to Joe B.'s health, or China doing something warlike.

The Strangest Story of Self-defense

Death by landscaping bricks. Shooting Suspect Stoned To Death By Group In Fort Worth: Police | Dallas, TX Patch

He started shooting. He killed one person and injured two others. They responded with what was available.

The police narrative indicates the brick-throwing to be more of a self-defense response than a traditional stoning.

There are not many details provided, but the police say there was a distrubance before the shooting.

Self-defense is a human-right. And this all happened in Texas.

In the words of the Babylon Bee, This News Is Weird.

"A minor infraction that likely would have resulted in a citation at most turned into an officer fighting for his life," said the Aurora Police Department chief.

Because they shouldn't have to obey the law. Or something.

The officer who was assaulted was treated at a local hospital and has been returned to duty.

Politics In Canada Are Even More Screwed Up than in the USA

And that is saying something. It is "only" the Green party, but it is still amusing. Green Party mutiny continues as they turn against Annamie Paul for being pro-Israel.

A black, Jewish woman, Annamie Paul, currently heads the Green Party in Canada. Apparently some of the members of the party have an issue with the Jewish part of that equation. Or so it would seem to me.

But the question is: why the acrimony? Why the infighting? Why the hate-on for Ms. Paul? Well, the unspoken reason why so many Greens are turning red with rage regarding Ms. Paul seems to have everything to do with… her opinions regarding Mideast policy?!

When tensions were hitting a boiling point with Israel and Hamas back in May, Paul issued a statement calling for a de-escalation and a return to dialogue. That sounds rational, but not to the “progressive” Israel-haters in the Green Party, of which there appears to be many.

One of the MPs "crossed the aisle" to the Liberal party, but was then forced to "apologize" from some antisemitic views.

The conflict has been so intense that a no-confidence vote was to be taken, but ended up going to an arbitrator first. Now the party is suing to overturn the result of arbitration. New court documents filed Wednesday in Toronto in the Ontario Superior Court of Justice against Green Party leader, Annamie Paul reveal the tortured process she has endured as she tried to stay in control of the party she was elected to lead in October.

Paul narrowly dodged a leadership review earlier this week as party old guard faithful to former leader Elizabeth May and vocal anti-Israel elements in the party try to maintain their stranglehold on the reigns of power.

They fired one of Paul's assistants around the time that one MP moved over to the Liberal Party.

And Trudeau's Liberal government was all set to exclude Paul from participating in their Antisemitism Summit. She is the "only Jewish federal party leader" so that didn't play too well. They relented and let her be an observer, but blocked her active participation. (Irony is not dead in Canada.)

So whenever you dispair about the state of things in Washington, DC, look at some of the other countries.

You Can't Do Everything Over the Internet

Or why your backup strategy might suck. Don’t Wanna Pay Ransom Gangs? Test Your Backups.

Even if you don't pay to keep the ransomware gang from disclosing your data, and your customers' data, you may still have to pay for a decryption key if you were backing everything up over the intertubes, and you expect to restore from those backups in the same way.

Even with the data transfer rates we enjoy today, if you have enough data, it can be that sneaker-net will outperform the internet. Seriously out perform.

“In a lot of cases, companies do have backups, but they never actually tried to restore their network from backups before, so they have no idea how long it’s going to take,” said Fabian Wosar, chief technology officer at Emsisoft. “Suddenly the victim notices they have a couple of petabytes of data to restore over the Internet, and they realize that even with their fast connections it’s going to take three months to download all these backup files. A lot of IT teams never actually make even a back-of-the-napkin calculation of how long it would take them to restore from a data rate perspective.”

Then, if your backups are encrypted (What do you mean your backups are not encrypted?), did the decryption key just get encrypted by the bad guys? That is poor planning.

In rare cases, they can corrupt your backups.

But the assumption that "we can do everything over the internet" is what kills most people.

Back in ancient times, when I was still working in Information Technology, part of my job was disaster recovery planning, and part of that was off-site backup and recovery. About once a year, most organizations would test their backup/restore procedures at an off-site vendor-location. For a week, or more, before the recovery test, companies would scream "Do you know there is a backup test?" And even then, stuff would be missed.

I only ever worked for one organization where corporate would spring the tests on IT without warning. That was the one organization where I was fairly certain that my paycheck would be cut, even if there was a fire in the data center. Everywhere else? The best disaster-recovery plan was to keep your résumé up to date on your PC at home.

If you want to transfer a few hundred gigabytes of data, it’s generally faster to FedEx a hard drive than to send the files over the internet. This isn’t a new idea—it’s often dubbed SneakerNet—and it’s how Google transfers large amounts of data internally.

Transmission rates have gone up since that was written, but so have the volumes of data involved.

So, what would you do, if you went out to lunch and came back to discover that a tanker-truck full of toxic chemicals had spilled on the highway in front of your building, and you couldn't get in? It wasn't a truck full of toxic chemicals; it was a bomb-scare, and we did get back in that afternoon, but it was an interesting thought experiment.

Felon Shot During the Commission of a Crime

The fact that the bad guy is 16-years-old is really beside the point. He was threatening a law-abiding citizen with a gun. Things didn't go well for him.

Just after midnight, a 41-year-old man was standing near his vehicle in the 2900 block of South State Street when he was approached by a teenage boy with a handgun, Chicago police said.

The man, who had a concealed carry license, shot the 16-year-old in the arm, police said.

Police took the would-be bad-guy to a local hospital, and arrested him.

I think it will be some time before the bad guys get the message that the law abiding just might be armed.

Good Guys 1, Bad Guys 0.

How's That Affordable Bail Working Out?

Cases 29, 30 and 31, of people out on bail for felonies, accused of killing, trying to kill, or shooting someone in Chicago. Note the arrest must be for a new offense.

Keeping people in jail is unfair.

Fist up, Christopher Solis-Govea. #29: On electronic monitoring for gun case, man escapes and shoots victim in the face, prosecutors say | CWB Chicago.

He posted bail in January, but went AWOL from electronic monitoring, and a judge issued an arrest warrant on January 15th.

Solis-Govea remained at large until Tuesday, when CPD’s fugitive apprehension unit arrested him for allegedly shooting a man in the face on March 3 — almost exactly two months after Judge Ortiz lectured him about the potential consequences of firing a gun.

Next, is Karon Hunt. #30: Man, on bond for gun case, shot woman 10 times in her back, prosecutors say.

Prosecutors said the alleged victim, a 28-year-old woman, was hanging out with friends on the 7300 block of South Prairie when Brunt joined them and began talking with her around 1:30 a.m. on May 23.

The woman noticed a gun in Brunt’s waistband and decided to walk back to her car, Assistant State’s Attorney Gail Bembnister said. As she got into the vehicle, Brunt pulled out the weapon and shot her ten times in the back, according to Bembnister.

And finally Jerome Powell. #31: Man shot 2 victims in separate robberies while on bail for felony gun case, prosecutors say.

A man who was on probation for burglary and on bond for allegedly being a felon in possession of a firearm shot two victims in separate robberies less than an hour apart earlier this month, prosecutors said Sunday. Jerome Powell, 23, is now the 31st person accused of killing, trying to kill, or shooting someone in Chicago this year while awaiting trial for another felony.

But remember, Kim Foxx, not-so-affectionately known as Crimesha, Cook County State's Attorney, says that increased crime in Chicago is a "misconception."

So who is it unfair to, to keep felons in jail? Because it is not fair to the 31 people who have been victims.

Self-defense Is Legal in Virginia

I suspected that it was, but this decision was made at warp-speed, for the Criminal Justice System. Police: Dale City homeowner acted in self-defense in non-fatal, July 6 shooting of suspected intruder.

Prince William County police will not charge a Dale City homeowner who shot a man on his front porch who he encountered after hearing what sounded like someone trying to break into his house, police said Friday.

The Price Of A Mile

Sabaton is a Swedish Heavy Metal band that has a thing for historically based lyrics. They are planning a 2022 tour, and so they have released at least one new video, even though the song is not new. I will have to look for other videos.

This is "The Price Of A Mile" by Sabaton from their 2008 album The Art of War. While WWI is not my thing, this song is about the Battle of Passchendaele.

As for the battle itself...

Battle of Passchendaele, also called Third Battle of Ypres, (July 31–November 6, 1917), World War I battle that served as a vivid symbol of the mud, madness, and senseless slaughter of the Western Front. As for the tour... Sabaton announce The Tour To End All Tours for 2022. It will include The Hu (the Mongolian Metal band that everyone was going crazy over a year or 2 ago.) 26 cities have been scheduled starting in March of 2022, though I don't think they will be coming to North America.

The "Crime Is Down" crowd, being Police Superintendent Brown, Mayor Lightfoot, and Cook County State's Attorney Foxx, will all be spinning like mad. And the State's Attorney's office did say that the rise in crime in Chicago is a misconception.

And Indiana is not New Jersey.

Evansville police spokeswoman Sgt. Anna Gray said an armed man went into a home near the 1800 block of McConnell Avenue. The homeowner and the man reportedly fired their guns at each other, and the man who entered the house was shot.

Cops took him to a local hospital; he is expected to survive to face charges.

The investigation continues, but self-defense is a human-right.

Mob Randomly Attacks Guy Walking His Dog

He is a firefighter, off-duty at the time of the attack, but that isn't what started the issue. He had the nerve to ask them to stop setting off fireworks in the park. So they attacked him.

The 44-year-old victim said he was strolling with his 3-year-old Labradoodle Dylan in Juniper Valley Park in Middle Village at around 9:55 p.m. Friday when he was suddenly targeted by the mob.

“There were at least 100 kids … I was walking my dog. They just picked me out and approached me,” the still-shaken victim, who asked to remain anonymous, told The Post Saturday afternoon.

Curtis Sliwa, of Guardian Angeles fame, and current GOP candidate for Mayor, claims that police were in the area, but failed to respond to the attack. They did show up fairly quickly once it looked to turn nasty.

Police on Saturday confirmed to The Post that the victim was struck in the head with a glass bottle at 75th Street and Juniper Boulevard North. No arrests were made. The pooch, who was scooped up by a good Samaritan, was not hurt.

Once again we see that Hobbes was correct about what happens when law and order are abandoned.

It also brings to mind "The Second Coming by W. B. Yeats.

You can also file this under "Lies, Damn Lies, and Statistics." But then Math is Hard, especially if you're a lawyer. Or so it seems. More on that in a post for tomorrow.

Matthew Saniie, Cook County State’s Attorney Kim Foxx’s chief data officer, says that everything is fine. Things were bad last year, but they are better this year. And...

Saniie covered well-worn ground as he laid out statistics that he said show Kim Foxx is not soft on crime and bail bond reform doesn’t contribute to increasing violence.

That post for tomorrow will take a look at one of the key statistics around bail reform.

As far as things being better this year, not so much.

Chicago has recorded 72 homicides this month as of sunrise on July 21. If that pace continues, July 2021 will replace July 2020 as the worst July in the past 61 years.

What Do You Do When a Prosecutor Refuses to Prosecute?

You don't wait for them. Fed up with Kim Foxx’s office, alderman wants city to take some matters into its own hands.

This aldermen, ex-police-officer Anthony Napolitano, wants the city to hanlde some crimes itself, since Crimesha (Cook County State's Attorney Kim Foxx) refuses to prosecute.

The crimes range from “looting and mob actions,” vandalism, possession of etching materials, paint and other markers used for graffiti to unlawful possession of a firearm and firearms ammunition and offenses committed in “public transportation safety zones” or near schools, parks and playgrounds.

Some of the things that the prosecutor has decided is OK. The result has been chaos.

“Destroying property. Looting stores. … It’s happening every weekend. The wildings downtown right now where you have a mob of about 30 kids standing around beating people up on the corners, taking phones and purses in broad daylight,” Napolitano said.

“Every week, there’s another police vehicle or fire vehicle or city vehicle being destroyed by wildings. … We’ve got four-wheelers and motorcycles on sidewalks on Michigan Avenue riding around. If you drive down the Kennedy Expressway, the entire city is covered in graffiti. I’ve never seen anything this bad before. … We’re a lawless city right now.”

I wish him luck, but I believe that this is locking the barn door after the horse has escaped. (Hat tip to 19th Ward Chicago.)

Clark County sheriff's Detective Jeremy Brown, 46, was identified as the deputy who was fatally shot Friday evening at an east Vancouver apartment complex. The suspected shooter remains at large.

The homeowner, identified as a 44-year-old woman, reported to police that she was leaving her house when a masked man armed with a handgun approached her from the side of the home.

The victim, who was also armed at the time, shot the individual as they approached the front door of her residence. She was not injured.

So how is this better if she had been disarmed, and had to fend off a physical attack. It was clear that he wasn't there for any good purpose.

And the DA moved at lightspeed to make this determination. The shooting took place on July 22nd.

The following statement leads me to believe that this was a domestic violence incident, but there is not enough detail provided to say that is the case.

Police say the incident was not random. Following an investigation and consultation with the Commonwealth Attorney’s Office, the shooting was ruled to be justified based on self-defense.

Self-defense is a Human-right. Good Guys 1, Bad Guys 0.

Motherboard has also shown how wide spanning the customer base for this sort of location data is, with the U.S. military and various law enforcement agencies also purchasing it, skirting the need to obtain a warrant. And although the data was based on that generated by telecom networks and not apps, we also previously spoke to Ruth Johnson, a woman who was stalked and harassed by someone who gained access to her phone's location. Johnson said T-Mobile put her "life in danger." Motherboard also tied black market location data to the spot of a triple murder.

You have nothing to hide? You've obviously never had a violent stalker. And now that the Left has decided that insisting on "2+2 = 4" is racist, you are all headed for reeducation camps.

The decline of civilization is happening all around us. But let's look at one of the epicenters of the decline, New York City.

Unlicensed vendors/peddlers take over neighborhood after neighborhood. Prostitutes stroll certain sections of the city with no cops in sight. Prosecutors are not interested in enforcing laws against prostitution. Drug addicts have taken over the parks, because that isn't a crime either.

The result of the hands-off trend is a growing foulness and squalor in public spaces, courtesy of the government’s tacit approval for peddlers, druggies and hookers to create mayhem and diminish the quality of life for residents and businesses. While it’s not as deadly or frightening as violent crime, disorder is a pernicious partner and one often bleeds into the other.

They didn't like "Broken Windows" so they have put that philosophy into reverse, with the expected result. (Hat tip to Maggie's Farm.)

Polls Have Become Democratic Propaganda

Are we shocked, that polls from places like CNN are insane? But most seem to get it wrong consistently. Fact Check: Were 2020 Polls ‘Rigged’? Is There Even Any Need to Ask Anymore?

For example, CNN’s final national poll, released Oct. 28, the Wednesday before Election Day, had Biden leading by 12 points — TWELVE POINTS! — which was nearly eight points higher than the 4.5 actual margin. You cannot be that wrong by accident.

Another example of a failure of the victim-selection process. They probably didn't expect a good-guy to be armed in California. Homeowner shoots, kills intruder in Guinda, California

When deputies arrived, they found two people had been shot, according to a Facebook post by the Yolo County Sheriff's Office. One of them was pronounced dead at the scene and the other was taken to a hospital with a serious injury from the gunshot.

Deputies determined that the shooter was the property owner, who was not injured, according to the Facebook post.

This seems to be a trend, at least in parts of California.

This is the fourth known instance of a homeowner shooting an intruder this summer in the Greater Sacramento region.

Self-defense is a human-right, and even in California, it might be your legal right.

Two guys decided it was a good idea to break into an occupied home on the South Side of Chicago.

The homeowner and two other people got into a physical confrontation with the home invaders. Chicago police said that’s when a gun went off and one of the invaders was killed. The other ran away and hasn’t been caught.

The investigation continues, but self-defense is a human-right, even in Chicago. It is still to be seen if the Criminal Justice System (sic) in that locale will recognize it as a legal right.

FBI = Funded But Incompetent

I'm shocked to read that the FBI would disregard public safety. OK, I'm not shocked at all. The FBI has been about doing whatever at least since COINTELPRO.

Officials with the Indianapolis FBI office made false statements, failed to respond for months leading to more than 100 other gymnasts being sexually abused and exhibited "extremely poor judgment" in the handling of 2015 allegations against longtime USA Gymnastics team doctor Larry Nassar, according to a stinging rebuke Wednesday from the Inspector General of the U.S. Department of Justice.

Of course one of the FBI agents making those statements was trying to get a job with the Olympics/Paralympics Committee

The report added Abbott violated ethics guidelines while negotiating for a job with the U.S. Olympic and Paralympic Committee during the investigation.

Public servant? Don't make me laugh. He was busy trying to get a job for after his retirement. Guess what he thought was more important: That job, or the safety of athletes exposed to Larry Nassar.

COVID-19, Nursing Homes, and Canada's Answer to Cuomo

"Kill the Old People" seems an extreme way to cut costs.

A nurse testified that the Sainte-Dorothée long-term care facility consistently administered morphine instead of attempting to prolong the life of elderly residents who were believed to have COVID-19.

“They didn’t all die but most did,” Sylvie Morin said.

Including at least one person who never tested positive for COVID. Well they don't know, because the test was "lost." Or could it be that the test didn't come back the way that would have been good for the nursing home.

There are more details and a law suit.
