Second Suspect Arrested in Texarkana Shooting

This was an incident that occurred during the early morning hours of New Year's Eve. Teen arrested in connection With fatal Texarkana shooting after alleged car break-In | News | KTBS

Police have arrested a 16-year-old boy in connection with a fatal shooting that followed an alleged vehicle break-in last week in Texarkana. Authorities said Friday the teen was the second suspect involved in the incident, which occurred early Wednesday morning on North Park Road. The other suspect, a 15-year-old, was shot by a homeowner and later died at a local hospital. Police have not released the names of the juveniles.

As stated at the time of the incident, the investigation is going to take some time.

The police/DA have not said what, if any charges will apply. I'm no lawyer, but the internet (including the Wiki - always a questionable source) assures me that the Felony Murder Rule applies in Texas. No one knows if will apply in this case, because as far as I can tell the DA has not listed charges, or it may be that they won't publish the charges due to the age of the suspect.

Self-defense is a human right.

Who Knew Felony Murder Was a Thing in California

Friend. Accomplice. It is all a matter of perspective, and the perspective of Professional Journalists is a bit skewed from reality.

David Washington, 39, pleaded no contest to voluntary manslaughter in the March 2024 shooting death of 39-year-old Charles Calloway. Police said Calloway was killed by the resident of a home on the 1300 block of 102nd Avenue in East Oakland but Washington was charged with murder under the legal theory that he and Calloway forced the man to use lethal force in self-defense.

The Professional Journalists (so called) can't even say what the legal theory is. It is that if you commit a felony, and someone dies as a direct result of that crime, then you are responsible for that outcome. It falls under the heading of personal responsibility. Something that is completely foreign to journalists and the Left, but I repeat myself.

Was this guy a saint? No. But if you click thru, you will see that he was clearly in the wrong.

And I suppose it needs mentioning, that the guy who died, did so as a result of armed self-defense.

I'm sure that the Left will move to make this go away in the future, because being held responsible for your actions is against everything the Left believes.

Felony Murder in Florida

I predict the Left will be screeching about how unfair it is to be held accountable for the completely foreseeable consequences of your actions in a few minutes. 2nd suspect in home invasion that led to deadly self-defense shooting arrested: SPPD | FOX 13 Tampa Bay

This is about a self-defense shooting that took place in the middle of April.

The backstory: On April 16, SPPD said two men entered a home in the 3400 block of 40th St. N around 2 a.m.

Police said the homeowner fired shots, hitting a man later identified as Marcel James Williams, 20, who died at the hospital. The second suspect took off.

Ja'quavius Daniels turned himself in on Thursday.

Daniels faces a felony murder charge.

Though I suppose he is aiming for some kind of deal.

Felony murder goes by different names in different jurisdictions, but that is what it is called in Florida. It is a doctrine that holds if a person is killed as a direct result of someone committing a crime, then that person is responsible for that death. In Florida, breaking into homes is quite likely to result in an armed homeowner shooting someone. That is the case here.

The story at that time was that this homeowner was specifically targeted, though I never saw anything that said why that was the case.

And while 17-years-old does qualify as a "teen," I think there is a good chance that he will be charged as an adult. But then journalists love to paint the criminals as the victims.

One interesting note is that Lorenzo Stennis, 21, of Pascagoula was arrested January relating to a shooting in Gulf Port, MS that left several vehicles hit with bullets. He was not held in jail. Now he is dead. So how is that social justice working out?

On Monday night [May 13th], Gulfport PD officers arrived at a residence of 27th Street in response to reports of a shooting. They found [Temi] Lawal on the ground, dead of an apparent gunshot wound. They also learned that Stennis had been taken to a local hospital with multiple gunshot wounds, where he later died.

And in a move that will have the Social Justice Warriors screaming that "Felony Murder is Unfair," because you shouldn't be held accountable for the completely foreseeable consequences of your actions.

Lawrence Corley IV, 17, of Gautier is charged with two counts of capital murder.

Someone died while you were committing a felony. In Mississippi that is apparently known as capital murder, though most of us non-lawyers just think of it as felony murder.

The homeowners who defended themselves won't be charged, because self defense is a human right, and it also your legal right in Mississippi.

Felony Murder and Self Defense in California

Two guys broke into a home in east Oakland, California. The mistake they made was that the home was occupied, and the homeowner was armed.

After an exchange of gunfire, one of the men, Charles Calloway, was dead. His alleged accomplice, David Washington, took off, only to be arrested 10 days later.

Now Washington, 38, faces a murder charge in Calloway’s death, even though police don’t believe he fired the fatal shot, court records show. Washington is expected to enter a plea during a hearing in Alameda County Superior Court on Friday.

That is what most of us non-lawyer types call Felony Murder. Someone died as a direct result of a crime you were committing, so you're responsible. Or in this case David Washington is responsible. Allegedly. That is what the courts will decide I guess. The crime has different names in different jurisdictions, but they all share one thing in common; The Left believes that it is unfair to hold people accountable for the perfectly foreseeable consequences of their actions.

And since we are dealing with California, the journalist in question is either confused, or sure that his readers are confused, about self defense.

In the exchange of gunfire at the East Oakland home on March 15, the homeowner was shot in his foot and was hospitalized, police said. He was not charged with any crime. Under state law, homeowners are allowed to use deadly force to defend themselves against intruders if they fear for their safety, legal experts said.

And as for the Left REALLY not liking Felony Murder, click thru for the restrictions placed on its use by prosecutions in that state. It is quite frankly, insane.

In the meantime, self defense is a human right, and even in The People's Republic of California, it might be your legal right.

A homeowner was confronted by two home invaders. Gunfire was exchanged. The homeowner was shot in the foot. One of the two bad guys was killed. The other bad guy is charged with murder. That situation goes by different names in different jurisdictions, but most of us non-lawyers call it Felony Murder.

The March 15 killing of 39-year-old Charles Calloway has now been deemed by police and prosecutors a justifiable homicide, according to court records. But Calloway’s 38-year-old alleged accomplice, David Washington, has been charged with murder under the legal theory that he provoked the homeowner who killed Calloway into using lawful self-defense.

See what I mean about being shocked. The journalist has to call the idea that you are held responsible for the completely foreseeable consequences of your actions a legal theory. What it actually is, is the law in a lot of places, including Deep Blue California.

The homeowner's foot was treated. The one bad guy died at the scene. The other alleged bad guy was identified with "digital evidence" and security camera footage from the time of the shooting.

Is Self Defense is becoming a common thing in California? It seems so to me. Self Defense is a Human Right.

Amite County, Mississippi is on the Louisiana state line, about 35 miles from Baton Rouge. Liberty, Mississippi is about 50 miles in a straight line (roughly) north of Baton Rouge, or an hour by car.

Canaan Curtis, 17, of Gillsburg, was shot and killed outside a residence on Highway 569 just north of Liberty.

Curtis had two 16-year-old accomplices with him. They were not harmed, but they now face charges of second-degree murder.

If someone is committing a felony, and anyone dies as result of that crime, that person who was committing the crime is held responsible for the death, regardless of who pulled the trigger. In this case the crime was robbery, and the homeowner did the shooting. But the accomplices are charged with the death. This situation has different names in different jurisdictions. Most of us who aren't lawyers call if felony murder.

The names of the two accomplices were given in the article, so I take that to mean they are being charged as adults.

If someone is killed as a result of you committing a felony, then you are responsible for that death. You created the circumstances that lead to the death. It has different names in different jurisdictions, but most of us who are not lawyers call it felony murder.

A Bessemer man has been charged with murder in the death of an acquaintance who was fatally shot by a Hueytown homeowner last month.

Hueytown, Alabama is about a 20 minute drive southwest of Birmingham on Interstate 20. Bessemer, Alabama is about 5 miles northwest of Hueytown.

There are very few details provided, aside from who died, and who is charged, but the list of charges indicates that there is quite a story.

La’Garyeus Lamar Boglin, 26, is charged with felony murder in the Feb. 19 slaying of 43-year-old Contravia Lamond Jackson.

Boglin is also charged with first-degree robbery, first-degree kidnapping, and first-degree burglary in connection with the same incident.

The Left hates Felony Murder because they hate consequences generally.

In this case, the homeowner, the person who actually did the shooting, was not charged because self-defense is a thing in Alabama. And it sounds like he may have also been defending his sister. That isn't clear because of the lack of details.

Earlier this week, a man was charged with first-degree murder after a south Phoenix armed robbery left one of his accused accomplices dead.

But, Omar Rivas, the man charged, did not pull the trigger of the gun that killed 19-year-old Mia Padilla. The homeowner shot at the two, and another one of their accomplices as they fled from his house, court records show.

A former prosecutor outlines the way the law is structured and used in Arizona, and they detail a list of crimes in which felony murder can be invoked.

Then they launch into the "Felony murder is unfair" litany, including references to Canada and (the country formerly known as) Great Britain.

Romley explained that the rule is a controversial provision and prosecutors have to look at all the facts and exercise good judgment on whether or not to apply the rule.

For that reason, some criminal justice advocates have tried to repeal or narrow the rule.

Because you can't hold people accountable for the consequences of their actions. That would be unfair.

The Left Will Cry "Felony Murder is Unfair" in 3, 2, ...

Police said Kaylee Grigsbyleinum and her boyfriend 21-year-old Devyn Strickland planned to rob a resident on Shady Place in Daytona Beach on Jan. 11

While inside the residence on Shady Place, police said Strickland was stabbed in self-defense by the resident before fleeing the scene with Grigsbyleinum.

Strickland died a short time later at a local hospital.

He was stabbed, not shot, so the narrative falls apart there, so I expect that this will be a local story. "No national interest." Though the Left does hate felony murder. Be held responsible for the completely foreseeable consequences of your actions? The Left won't stand for that!

A husband, wife, and a two-year-old child were at home when a group of miscreants appeared at the back door to the home.

Here is how the crime went down:

The wife was ordered to get on the ground at gunpoint and the suspects allegedly fired several rounds into the home. After learning that the homeowner was armed, the suspects fled the scene. The victims exited the residence and found [Andretti] Austin, who was an additional suspect, dead on the property.

From that statement I believe that the dead guy was shot by one of his companions while they were on their way in. That is a failure of safe gun-handling, which is stupid. There are varying numbers of rules, depending on who you talk to, but the 4 rules that most people cite, would keep this kind of thing from happening.

Anyway, four adults were eventually arrested.

On Wednesday, October 26, 2022, officials confirmed that 18-year-old Keaton Arnold, 23-year-old Tyrese Henry, 22-year-old Carlton Henry, and 22-year-old Zykeial Gulley are each facing charges of 36 counts of committing a terroristic act, aggravated residential burglary, first-degree battery, two counts of aggravated assault and capital murder.

A death occurred as a foreseeable consequence of their actions while they were committing a felony. The lawyers call that by different names in different places, but most of us non-lawyer-types call that Felony Murder.

The Left will be screeching about that is not fair in a matter of minutes. Hold people accountable for the consequences of their actions? What next, individual responsibility of funding retirement?

Being armed in your own defense is not a guarantee that nothing bad will happen. The homeowner was shot. But his being armed is why they left, or do you think they would have left living witnesses behind to testify against them?

In addition to the 4 men listed above, there are two juveniles who were detained with regards to the this incident.

A home-invasion robbery leads to Felony Murder charges. This is probably not what they expected to have happen. Four people arrested after homicide investigation in Levy County

Cedar Key, Florida is on the Gulf Coast about due west of Ocala, and SW of Gainesville, where you find the University of Florida. It is not quite in the center of The Big Bend. (The extent of The Big Bend tends to change depending on who is doing the defining.)

At least 5 people staged a home-invasion robbery in Cedar Key, Florida on August 14th of this year. The homeowner shot one of them, Anthony Brown, who died of a gunshot wound at a local emergency center.

Four people have been arrested and are in jail charged with homicide. Their actions - the home invasion - lead directly to the death of their accomplice, Anthony Brown. In Florida, this is not an unheard of outcome, with the level of armed citizens in that state.

When someone is charged with murder because a death that occurred when they were committing a felony, such as home invasion, most of us laymen call that Felony Murder. The lawyers in different parts of the country call it by different names.

The case is not closed, as police are searching for more (or at least one more) suspects.

Deputies say that the homeowner is not being charged.

That is because Self-defense is a Human-right, and in Florida, it seems to be your legal right.

Felony Murder In Florida

He apparently convinced a 16-year-old kid to go along with him, but that 16-year-old paid the price. Man arrested, teen accomplice killed in Fort Myers home invasion robbery - NBC2 News

The two miscreants - Richard Cochran, 38, and Robert Mosley, 16 - were acquainted with the homeowner, but the sheriff is not saying how, or if that lead to the invasion in some way.

On Sept. 20, the two suspects broke in to a home on Brandon Street through the home’s back door while armed with guns. Cochran held several people inside the home at gunpoint while Mosley searched the home.

Mosley came into contact with another resident while he was searching the home and shot them. Sheriff Carmine Marceno said the resident that was shot was a juvenile who did not die from their injuries.

After hearing the gunshot, the homeowner came out of his bedroom with a handgun and shot and killed Mosley.

At that point Cochran ran.

Normally I would expect the Left to be screeching about how Felony Murder is unfair. You shouldn't be held responsible for the completely foreseeable consequences of your actions. But that doesn't matter in this case, because it will not receive any national attention.

Self-defense is a human-right, and in general, Florida takes a dim view of home invaders.

Having to Face the Consequences of Your Actions

This all started back on April 26th. Homicide in the 6200 Block of Boxcar Run

Three people decided that it would be a good idea to rob an occupied home, in Texas. [Insert Facepalm here.] They were wrong.

Detectives learned that Joseph Mathews, Yoham Delgado and Tiffany Ruoff drove to the residence with the intent to rob the homeowner. During the home invasion, Joseph Mathews was shot by the homeowner.

One of the other 2 was arrested that night, and the second miscreant was arrested in June. Both were charged with burglary, and released on bail.

In September, Joseph Mathews died as direct result of the injuries he received during the April crime.

On October 5, capitol murder warrants were filed on both Delgado and Ruoff. Ruoff was taken into custody on October 6 in Hays County. Delgado remains at large.

They thought they were going to score some cash, or whatever. One is dead, two are facing a very long time in prison. Though I suppose in Austin the prosecutor will work to reduce the charges.

And the Left in general will be screeching about how Felony Murder is unfair sometime between now, and the start of the trial. The very idea that you should be held accountable for the very-foreseeable consequences of your actions is poison to the Left. But it was foreseeable. This didn't take place in New Jersey, after all.

They thought it would be a good idea to rob an occupied home. They were wrong.

Police said the three were trying to force their way into an Independence home around 2 a.m. Wednesday when they were confronted by the home’s residents. Police said Lockhart pointed a gun at one of the residents, who then shot the teen. Lockhart was later found dead outside the house.

The two would-be bad-guys who are not dead have been charged with Second Degree Murder in addition to first-degree attempted robbery and armed criminal action.

I'm guessing this isn't how they expected things to work out.

Felony Murder By Any Other Name...

On December 8th, 4 people decided that it would be a good idea to stage a home invasion. They were wrong.

Renard Causey Jr. and Justin Hill were shot and killed by the homeowner. Renard Causey Sr. and Jason Leblanc were shot and wounded. When they got out of the hospital they were arrested on charges of home-invasion, armed robbery, and murder.

The murder charges allege that the men’s acts resulted in the deaths of their confederates, identified by the parish coroner’s office. [SNIP] A news release on Dec. 9 said the homeowner called deputies, saying he shot at four men who had entered his home armed with guns.

Lawyers have different names for it in differt parts of the county. Most of us just call it felony murder.

You are responsible for the completely foreseeable consequences of your actions. If you choose to invade someone's home, there is a chance you will be met with deadly force. Anything that happens stems from your illegal entry, and is your fault. The Left hates that notion. Individual responsibility for individual choices? Can't have that.

The homeowner has not been charged, because self-defense is a human-right, and in Louisiana it is mostly your legal right.

Felony Murder in California?

Murder and other charges were filed Tuesday against a felon whose alleged accomplice in a Desert Hot Springs residential break-in was fatally shot by an occupant of the targeted home.

The idea that you are responsible the foreseeable consequences of your actions is, I thought, too conservative for the folks in California. Individual responsibility? Maybe that is only LA and San Fran that have issues. With this, they have plenty of other issues.
