Judge Brian Oakley with Romulus's 34th District Court dismissed the murder charge and the charge of using a firearm during the commission a felony Sept. 4 after hearing some of the evidence in the case during the preliminary examination and determining Peterson shot Carey in self-defense, said Burton-Harris [attorney for the guy charged] and Assistant Prosecutor Maria Miller.
The dead guy was the ex-boyfriend of the shooter's mother. There was a long history of domestic violence. The two had been in an argument, which escalated. Cops showed up to the scene of a shooting and arrested the guy still alive. The District Attorney then brought charges, because that is what they do. Or what they are supposed to do. But lately it seems they don't go after the real bad guys, but the legal gun owners.
Romulus, Michigan is in Wayne County, about 14 miles southwest of downtown Detroit. Romulus is home to Detroit Metropolitan Wayne County Airport.
"My client, like anybody, is happy to not have the most serious charges hanging over his head, but he is not happy about the situation," Burton-Harris said. "He's certainly not happy about having to do what he had to do. He understands and acknowledges someone lost their life. It's a very unfortunate situation."
Prosecutors are still deciding whether or not to appeal this decision, because they hate self-defense.
Self-defense is a human right, and it seems to be your legal right in Michigan.
