DA George Gascon Is Not Above the Law

The Los Angeles District Attorney cannot ignore the laws that he doesn't like. Los Angeles DA George Gascon ‘overstates his authority,’ can’t ignore California law, court rules

"On the merits, we conclude the voters and the Legislature created a duty, enforceable in mandamus, that requires prosecutors to plead prior serious or violent felony convictions to ensure the alternative sentencing scheme created by the three strikes law applies to repeat offenders," the ruling said. "The district attorney overstates his authority. He is an elected official who must comply with the law, not a sovereign with absolute, unreviewable discretion."

He is charged with upholding the law. He is not able to make it up as he goes.

The court’s opinion affirms a 2021 preliminary injunction issued by Los Angeles County Superior Court Judge James C. Chalfant, who ruled that Gascón’s three-strikes enhancement ban is illegal and violates the rights of prosecutors.

“The district attorney overstates his authority,” the appellate court said, concurring with the lower court ruling. “He is an elected official who must comply with the law, not a sovereign with absolute, unreviewable discretion.”
