Self Defense Is Legal in Arkansas

It seems to have taken a long time for the powers that be to admit this. Elderly Fort Smith man who killed intruder justified by officials | 5 News Online

As I have often said, persecutors HATE self defense. It seems that Fort Smith, Arkansas is not an exception to that rule. This incident took place in June of last year. Yet apparently this determination was only made this week, unless we think the news station is reporting on events from months ago?

There was witness testimony, in the event a neighbor of the guy whose home was broken into. Physical evidence and recording of a 911 call.

The neighbor called the homeowner to warn him of someone trying to break in. The homeowner armed himself and called 911.

Soon after, the intruder managed to break the glass with an object and started to enter the home through the shattered glass. That's when the homeowner "fired two rounds from his shotgun."

That will ruin your day.

The family says "he was off his meds." Only proving that Crazy People Are Dangerous, with apologies to The Other McCain.

The press release states "physical evidence at the scene confirmed the statements given by the homeowner and his neighbor about where and how the break-in occurred."

After careful investigation, county officials concluded that the homeowner used "deadly physical force in defense of a person," and will not be facing any charges.

The only real question is, "Why did it take so long to make this determination?" My guess is that the DA in the case was really hoping to charge someone with something, because DAs HATE self defense. Which is a human right.
