This Case Should Never Have Gone to Trial

But DAs HATE self-defense, and in Hallsville woman found not guilty in 2023 shooting death of estranged husband

The shooting happened after a verbal altercation about Ellis moving out caused Harris to retreat to her locked bedroom bathroom, where Ellis broke down the door.

If I'm so afraid of you that I lock myself in the bathroom, and you break down the door, I think you could reasonably say that I am in fear of death or grave bodily injury. The DA didn't believe that, however.

At some point, “(Ellis) says if I can’t have you nobody else can have you, and that precipitates her move into the bathroom. When he walks into that darkened room, he sees a mattress gone. He can see she doesn’t want you there, because at this point this is not a conversation. She has said stop, go away. He enters one bedroom — that’s not his right. Then he uses force to break a door. When she sees no other option, she fires and does what she has to do and call 911,” [lead defense attorney Kyle Dansby said.]

The DA's justification? She had a Taser. If she was afraid, she should have used the Taser. Lesson learned: NEVER buy a Taser, or you will have to deal with idiot prosecutors.

Of course there was some (unnamed) conflict of interest with the prosecutor's office, so they had to get an attorney from a neighboring county to try the case.

Hallsville, Texas is about 140 mile drive east of Dallas, or about a 50 mile drive west of Shreveport, Louisiana.

Self-defense is a human right. And it is your legal right in Texas, but even in Texas, DAs HATE that.

    1. If only. DAs fall under the sovereign immunity insanity. To prove they are guilty of misconduct, they need to do something overt, like hide evidence, or not disclose a conflict of interest.

  2. Hallsville is just East of me. Great motorcycle road runs North out of town. The DA did not do anything that would have been In Line with the attitudes of the people I've met there. Not that I ever discussed This case, i just don't believe I've ever met anyone there who is so stupid as to believe she should have Tried the taser first. Yeah, angry guy between you and the door,and you're gonna Hope a taser stops him. Was it a Proper Taser? Or a hand held stun gun? IDK what gun she had. Sometimes angry men keep fighting after they have been mortally wounded.
    I hope that DA gets canned and as a private citizen, Nobody hires him.

  3. Make Prosecutors bear the costs of the defense for Capital cases where the defendant is acquitted. Would make them much less likely to engage in malicious prosecution.
