Except of course it wasn't a "poor dog." It was an aggressive dog, that was not on a leash. I would rather ask, "How could this dog's owner not keep it from attacking?"
“According to the initial reports, a male individual was walking his dog when two other dogs approached him that were not secured by the owner,” the news release says.
“The male reportedly warned the owner of the approaching dog to secure their animals. Despite this, one of the dogs attacked the male’s dog. In response, the male discharged a concealed firearm, firing one shot that struck the attacking dog.
Roy, Utah is roughly 30 miles north of downtown Salt Lake City.
So yes, you are allowed to defend yourself, and your dog. At least that is the case in Utah.
The moral of the story is, don't let your dogs run free if you can't control them verbally.
