Can you give me another explanation for why this ruling took so long? Fatal shooting in Vermillion, SD was justified, authorities say
This event took place back in the middle of May in Vermillion, South Dakota, which is about 40 miles northwest of Sioux City, Iowa.
Authorities say that Kinchen, a Vermillion resident, texted a friend that day saying he was going to “slaughter” the owner of the home on Cataline Avenue. That evening, Kinchen reportedly obtained a black facemask, dressed in all-black clothing, altered his appearance by shaving his face and got a handgun. He then walked several blocks to the Catalina Avenue home and forced his way in.
The homeowner was there with a guest. Kinchen chased the guest and fired his gun at the guest.
The guest reportedly got a handgun from a vehicle in the garage and returned fire. Kinchen was struck in the arm and chest and died because of those injuries.
By entering the home he invaded, he was in violation of a court order.
So you add all of that up, and I have to ask, "Why did it take so long to determine the shooting was justified?" My answer is that the prosecutor hates self-defense.
Someone will say that they were waiting on the toxicology. (His blood alcohol was nearly three times the legal limit to be driving.) And what, does the toxicology have to do with the other facts in this case? Would the shooting not be justified if he was sober, or even more out of this mind?
And another article does reference the South Dakota Division of Criminal Investigation. So waiting on a bureaucracy is probably part of the excuse. But again, what difference could it have made?
At least it seems that they got to the right place eventually.
This has all the earmarks of a domestic violence attack. That he was an ex-boyfriend or ex-husband turned violent stalker. None of the articles I have seen state that, however, so I can't say that for sure.
Self-defense is a human-right.
