There was witness testimony. There was physical evidence, including a knife. The shooter called 911.
Okay, the article actually does not say when the DA made this determination. But why would the media report on it now, if the DA made that determination in September? Or any other time?
Around 7 p.m. April 4, 2023, Nagle was visiting his girlfriend, Syncere Mitchell, at her apartment complex when a man, later identified as Yancey, entered through an unlocked door and sat at the kitchen table next to Mitchell’s roommate, Dennis Carlsen, according to the report. Yancey opened a can of beer he brought with him.
Carlsen asked Mitchell if she knew Yancey, and when she said no, they asked Yancey to leave the residence.

Self-defense is a human-right, and it might be your legal right in New Hampshire, but I'm not sure I would count on that being true.
