Though it took this DA MONTHS to come to that conclusion. Muncie woman found justified after killing intruder
So what should a woman do if a man breaks into her home? Make tea?
According to the Delaware County Prosecutor's Office, the woman had called the police to report a home invasion. When the police arrived, they found a person who had been shot and killed along with the homeowner and her child, who were not harmed.
The prosecutor's office released findings Wednesday that determined the homeowner was acting in defense of herself and her child when an unknown person had tried to enter her home.
There are some complicating factors, like the fact that she took a warning shot. Warning shots are illegal in a lot of jurisdictions, I don't know what the position of Michigan is on that subject. I still don't think it should have taken the DA from November of last year to make this determination. Was he hoping to find some reason to prosecute? Or did he finally think it over, and realize that prosecuting a mother for defending her child from a criminal was a losing proposition? Losing, whether in court or during an election, is not something DAs like to do.
Self-defense is a human-right. It may even be your legal right in Michigan Indiana.
Muncie, Indiana, not Michigan.
