a homeowner told them a young man he didn’t know was banging on his door around 4:00 a.m.
He told police he asked the man to leave, which he began to do. But then, the homeowner said he turned around and rushed towards him.
The family says he was confused following a seizure, and the regular rules of self-defense should not apply.
They go on at length about what he was like, before the epilepsy, and even after the seizures started.
But their is no mention of what happened the night he got shot, which is the only thing that matters.
What should someone if a person that they do not know rushes at them at 4 AM? At that point they won't know if that person is sick, drugged, crazy or evil. If there is a reasonable threat of death or grave bodily injury, they should be allowed to defend themselves. It doesn't matter what that person is like the rest of the time.
Saginaw assistant police chief Russell Ragsdale said in a case where a homeowner felt threatened on his own property, it's unlikely Russell’s medical condition will come into play.
“It is something we're looking at, but it doesn't play a really strong role in the investigation. What we have to look at is the events that unfolded at the time that the force was used,” said Ragsdale.
While this is certainly a tragedy, self-defense is a human-right.
There is always the question of why the family didn't watch their son after they knew that he was having seizures. He was out at 4 AM when the incident occurred.
