Self-defense is Legal in Pennsylvania

Though I think the DA is disappointed that he had to come to that conclusion. DA rules fatal shooting at South Huntingdon party a justified homicide.

A domestic "altercation" was turning nasty.

When the woman returned to the gathering, “she was upset, she had apparently suffered two black eyes,” [District Attorney John] Peck said. “Hoffman called the residence and said he was going to come back and shoot everybody there.”

People took cover. Two people armed themselves, and then the guy who made the threat came back.

The male resident fired a warning shot. Hoffman responded by firing his shotgun once.

“Then (Hoffman) fired a second shot, and he struck Michael Brown in the leg,” Peck said.

Brown then returned fire, hitting Hoffman five times. Hoffman’s blood-alcohol content was 0.207%, more than twice the legal limit to drive in Pennsylvania. Peck said it was a clear case of self defense and the defense of others at the party.

If it was "a clear case of self defense," why did it take more than 6 months for the DA to rule? Because DAs HATE self-defense. They want to prosecute. They don't care about Justice. They want to win. So what DA John Peck is really saying, "I know I can't win this one, even though I would love to try." Justice? What's that?

Still, it does get served almost by accident sometimes.

And self-defense is still a human-right.

  1. Why aren't DA reviewed after they prosecute people where there is questionable guilt as well as prosecute those cases where there is little evidence to substantiate a case.

    1. DAs are ELECTED officials. They are reviewed every 4 years. But they are reviewed by people who A. pay no attention, B. hate individual action and want everyone to be the sheep they are, and C. mostly don't vote anyway. (Unless it is a Presidential election most people can't be bothered to go the polls.)
