Alec Baldwin is NOT Cooperating with Police

New Mexico authorities on Thursday said they were working with police in New York state to obtain Alec Baldwin's cellphone after the actor failed to give up to despite a search warrant to seize it.
A lawyer for Baldwin did not respond to requests for comment as to why the actor has not yet handed over his cellphone to authorities.

The legal experts are giving excuses reasons for why he might not have turned over the phone. Why experts say Alec Baldwin hasn’t handed over his phone. I think they are mostly bogus excuses. Or reasons. Or something.

“If he deleted text messages or call records then he would face the possibility of criminal contempt,” said Kearon, who works at the Long Island firm Barket Epstein Kearon. “Or if there are personal messages, for example, between he and his wife, it’s not shocking that he wouldn’t want them in the public domain.”

That's on the plus side.

It’s also possible that text messages on the phone contradict previous statements Baldwin has made, Kearon said.

It's funny how someone suddenly decides that privacy is an issue. Does he use his fingerprint to open the phone, or a password? Does he use a secure form of communication?

Actually those experts make one valid point.

“For Baldwin to say, ‘Get a warrant’ might come across as arrogant or not forthcoming but it’s pretty common,” Shapiro said.

“He might be saying, ‘If you want my whole phone that gets into my personal life and I don’t want to pull other people into this,” Shapiro said. “But a warrant could narrowly tailor the case-related information that can be extracted from the phone.”

Asking cops to get a warrant should not be considered an insult or an admission of anything. The 5th Amendment is there for a reason.

Still, he did promise to cooperate.

  2. A subpoena for a phone issued two months after the incident isn't an investigation, it's a fishing expedition.

    Nobody was shot with his phone, and he wasn't selfying the incident. He and all the participants - except the guilty one, the armorer - have given sworn affidavits on the record. Any conversations with his legal counsel are privileged. Anything not germane to the case is pointless overreach, and is likely 98% or more of anything on his phone, at this point.

    Most of what they say they want - texts, log of numbers called, etc. - is information they could get from his cell phone carrier without any participation from Baldwin.

    They're fishing, long after the relevant time period. Nothing more nor less. And they know on any judicial review, the subpoena is quashed as overbroad. And until they delivered the subpoena, he was under no legal obligation to maintain anything on his phone for the convenience or whimsy of the NM authorities, and could have wiped the phone twice a day up until that point.

    If it were otherwise, they'd simply issue an arrest warrant for Baldwin, get him extradited back to NM, and taken their chances at trial.

    They haven't gone that way, because they'd probably have their @$$ handed to them in court, and they know it.

    It's nearly three months since the fatal incident, and they haven't arrested anyone.
    This isn't circumspection, it's simple inexplicable incompetence, of the same caliber than caused the original tragedy.

    1. I know, and under most situations I would be on his side. But this isn't most situations.

      Alec B. is a leftist asshole who hates guns and gun owners. And in standard Leftist fashion, after the tragedy, he went immediately to "It's not my fault." He then hit "Someone else is responsible" because he maintained that it was NOT his responsibility to ensure that the gun was unloaded. And then he claimed "The gun went off by itself," which even other actors have called a bogus statement. And then he said he would do everything to cooperate. But I think that was before he realized that any investigation would find him negligent.

      I know this is a tragedy, but basking in the schadenfreude is a given, for someone like this asshole.

    2. He's a Leftist asshole non pareil, but unfortunately for your schadenfreude, also completely innocent of any actual wrongdoing.
      1) It wasn't his fault.

      2) Someone else was responsible. Two Someones, in point of fact. Their entire purpose was to ensure that nothing like what happened ever could, one of them for whom it was her sole and entire job, and who had to deliberately ignore or violate something like 60 (out of 79 or so) industry-specific safety practices, in force since before she was born. She's should, and is probably going to, fry for that, which is why Baldwin bears no culpability.

      3) Given the peculiarities of the Colt SAA used, and his description of thumbing the hammer, the gun very likely went off without anyone touching the trigger. Just poorly slip-hammering it, exactly as anyone who's ever handled one knows could happen, since about 1875.

      4) You really don't want to drag "other actors" into this in any capacity. It's like calling blind retards as witnesses, which will always blow up in your face.

      Enjoy the fact that that karma has made @$$hole Baldwin its bitch, for the rest of his life and beyond the grave, even if he never gets charged with any crime. that's probably all you're ever going to get from this.
