Self-defense Is Legal in Orange County

You can never really be sure when it comes to the Blue States. And even in Red states, some DAs hate self-defense. OC's DA Clears Newport Beach Homeowner in Fatal Shooting

Orange County prosecutors have concluded that a Newport Beach homeowner acted in self-defense when he fatally shot an intruder in August, the Orange County District Attorney’s Office announced Monday. [SNIP]

Lehr had left a residential detox center about 4:10 a.m. that day and told staff he was seeing “demons,” according to the Orange County District Attorney’s Office.

He went a few houses away, and was pounding on the door and demanding to be let in. So apparently you can file this under "Crazy people are dangerous."

“A homeowner has the absolute right to protect themselves from someone who breaks into their home in the middle of the night and threatens their safety,” Orange County District Attorney Todd Spitzer said.

It is good to hear a California DA say such things.

Self-defense is a human-right, and even in California it might be your legal right as well.

  1. ut there was no mention of moving the "group home" or of re-training the staff. The neighbors should ALL be notified to get better door security. Happened once, it will happen again. Maybe they shouold try for a partial rebate on their property taxesa due to the "nusance" that was allowed in their neighborhood.
